UN expert urges greater independence for courts in the Maldives

Judges and lawyers in the Maldives are not sufficiently independent from external pressures and interferences, a United Nations independent expert warned today wrapping up a visit to the Indian Ocean archipelago.“The concept of independence of the judiciary has been misconstrued and misinterpreted in the Maldives, including among judicial actors,” the UN Special Rapporteur on the independence of judges and lawyers, Gabriela Knaul, told journalists in Malé. Ms. Knaul noted that a power struggle which ensued from a “lack of understanding in the delimitation of the respective competences” of the Parliament, the Government and the judiciary had “serious implications on the effective realization of the rule of law.” She added that the separation of powers is “the bedrock upon which the requirements of judicial independence and impartiality are founded” and represents an essential requirement of the proper administration of justice.

"I have heard from numerous sources that the current composition of the JSC is inadequate and politicised. Because of this politicisation, the Commission has been subjected to all sorts of external influence and consequently has been unable to function properly," Knaul said.

India moves to end Maldives standoff
A Maldivian court Wednesday postponed the trial of opposition leader Mohamed Nasheed, who has taken refuge in the Indian embassy, as New Delhi sent an envoy to try to end the political standoff. The court postponed the hearing scheduled for Wednesday after police said they were unable to arrest the former president and bring him before the magistrate, according to Nasheed’s party. “The hearing was cancelled after police informed the court that they were unable to bring Nasheed (to court),” a spokeswoman for Nasheed’s party, Shauna Aminath, told AFP. Former foreign minister Ahmed Naseem said the government could re-schedule another hearing “at any time” and try to arrest Nasheed again. Presidential spokesman Masood Imad confirmed that the hearing had been cancelled but insisted that the case was still pending. Nasheed has been at the embassy in Male since last week, when an arrest warrant was issued after he failed to attend court for what he called a politically-motivated trial aimed at disqualifying him from elected office. Top Indian diplomat Harsh Vardhan Shringla arrived in the Maldives and was due to hold talks with political leaders in the nation of 330,000 Sunni Muslims, a government source said. Nasheed’s Maldivian Democratic Party said they wanted the Indian envoy to secure guarantees of safety for him before he leaves the embassy, and also to secure an agreement that he can stand in the September 7 presidential election.

Maldives Polls: It's over the other 50 per cent voters?
With the presidential elections now set for September 7, political parties in Maldives are vying with one another to identify issues and package them attractively for the voters, many of them youth. Number-crunching does not make things easier for them, given the complexity of the poll and the processes, and the inadequacy of a pattern that they could be relied upon with a certain level of accuracy. The official notification of the polling date is not expected before July. If no candidate polls more than 50 per cent vote in the first round, there has to be a second, run-off round, between the top two. The Election Commission has fixed the September 21-27 window for the purpose. The official notification, when made, could throw clarity on this score.

Halal Pork - Muslims have themselves to blame
Investigations following the detection of horse meat DNA in burgers sold in British supermarkets eventually also led to the discovery of pork DNA in processed food supplied as halal produce to prisons throughout the UK. The the response is probably as scandalous as the discovery. On the non-Muslim side the emphasis was on this having been an unfortunate isolated accident. On the Muslim side it was a lot more muted than that concerning cartoons nobody every saw. Somehow one got the impression that as long as only prisoners were affected it didn't matter all that much and, in any case, they had consumed the food unknowingly and thus were forgiven. The only key concern was that other services and outlets would not also have been supplied by the same firm, McColgan Quality Foods of Northern Ireland. The firm's website has been taken offline, making it impossible to check who certified them as halal in the first place.

India Needs To Engage With Maldives, Not Detach Itself – Analysis
Foreign policy making in a nation aspiring to be a global power of consequence is expected to become increasingly sophisticated as years pass by. In Maldives, however, New Delhi’s policies continue to display elements of infantilism. A series of blunders since the past one year pose the real danger of alienating Maldives for good. Contrary to general perceptions, the Ambassadors and High Commissioners play only an outside role in foreign policy making. For the ambassadors making Delhi undertake specific projects and positions in countries of their residence has always been an uphill struggle. The joint secretaries in the Ministry of External Affairs (MEA) make or break policies, according to their own understanding and capacities. However, the position of ambassadors and HCs assume immense importance in specific countries where the MEA either has no on-ground wisdom or has only peripheral interest. Male was such a case in point.

Global warming has caused monthly records for heat to increase fivefold in frequency, according to a study by scientists in Germany and Spain, published on Monday. In parts of Europe, Africa and southern Asia, the frequency of months with record-breaking heat has surged tenfold, it said. The evidence comes from an analysis of 131 years of monthly temperature data, monitored at 12,000 points around the world, which are stored in a NASA database. If man-made warming is stripped out of the equation, 80 percent of the records for hottest-ever months would not have occurred, it said. "The last decade brought unprecedented heatwaves, for instance in the US in 2012, in Russia in 2010, in Australia in 2009 and in Europe in 2003," said Dim Coumou of the Potsdam Institute for Climate Impact Research near Berlin.

Making whole wheat bread taste and smell more appetizing

The key to giving whole wheat bread a more appetizing aroma and taste may lie in controlling the amounts of a single chemical compound that appears in the bread, which nutritionists regard as more healthful than its refined white counterpart. That's the finding of a new study in ACS' Journal of Agricultural and Food Chemistry, which opens the door to making whole wheat bakery products more appealing to millions of people. Devin G. Peterson and colleagues explain that whole wheat flour includes all three layers of the grain - bran, germ and endosperm - while refined flour is mostly endosperm. Whole wheat flour contains more fiber and compounds called phytochemicals, both of which can help reduce the risk of cancer, heart disease, diabetes and obesity.

The Nation Is Now At Stake
By N. Sathiya Moorthy, The Sunday Leader, January 13, 2013

What the ‘Geneva vote’ in March last could not achieve, it now seems, the Parliament vote on Chief Justice Shirani Bandaranayake’s impeachment is capable of attaining. It was argued then that the Geneva vote aimed at destabilising not just the incumbent government but Sri Lanka as a nation. Despite the vote, the Geneva process did not achieve that goal. Today, the impeachment vote can do it, without instigation from outside and exclusively from within. With 117 MPs from the ruling combine signing the impeachment motion, the dye had been cast. There was no doubt which way would the PSC go, or which way would the vote in Parliament. Yet, the decision of President Mahinda Rajapaksa to seek advice from four individuals on the voted motion, and the declaration of the Government that the President could take his time deciding on the impeachment order that he would have to pass, gives some hope that the nation was still not at the brink – though not far away from it, either.
