Committee decides to replace Fahmy


Committee of the Peoples' Majlis has decided to replace the Fahmy Hassan, the Chair of the Civil Service Commission with another nominee.

On 20 November 2012, the People’s Majlis dismissed the Civil Service Commission Chair Mohamed Fahmy Hassan, with 38 votes in favour and 32 against, pursuant to Article 187 of the Constitution. On 11 December 2012, a case was lodged by former Civil Service Commission Chair Mohamed Fahmy Hassan against the People’s Majlis decision to impeach him, following which the Supreme Court ruled that the contested decision by the People’s Majlis to remove him is unconstitutional.

The Committee decided that the Supreme Court's verdict opposes the constitutional powers granted to the Peoples' Majlis and therefore the Supreme Court has no authority to interfere with the decisions of the Majlis.

The committee consists of five members from the opposition Maldivian Democratic Party (MDP) and five members from parties representing the government coalition. However no members of the government coalition except Vilufushi MP Riyaz Rasheed and Chair of the Committee were present in yesterday's meeting.

All members present at the meeting except MP Riyaz Rasheed voted in favour of the decision to replace Fahmy. Committee chair MP for Kulhdhufushi, Mohamed Nasheed also favoured the decision of MDP members.
