Case of the Military detention of Judge Abdullah will be sent
to PG soon: Police
Maldives Police Service (MPS) has said that the case of the arbitrary arrest of the Chief Judge of the Criminal Court Abdullah Mohamed during the regime of former President Mohamed Nasheed will be sent to the Prosecutor General soon.
Police Media Official, Sub Inspector Ahmed Shiyam said that the investigation of the Police on the case of the former government’s arbitrary arrest of the senior judge of the Criminal Court is almost finished. He noted that the Police have not received any cooperation of the ex-President in the investigation.
Shiyam said that the attempts of the Police to take the testimony of ex-President Nasheed have been unsuccessful so far. He said that the Police gave Nasheed the opportunity to give the testimony at any time and any place convenient for him but he has denied the Police from giving any support in the investigation.
Despite this the Police will file the case at the Prosecutor General’s office against all involved in the arbitrary arrest without any exception, said Shiyam
Former Defence Minister Tholhath Ibrahim Kaleygefaanu was summoned to the Police headquarters in relation to the case but he used his right to remain silent.
Although the Police have the authority to arrest ex-President Nasheed under a court warrant to investigate the case, the Police have not done so. Police Commissioner Abdullah Riyaz said that he does not believe that anyone should be arrested to investigate the case.
During the last days of Nasheed’s regime, the government compromised the independence of the judiciary by arbitrarily arresting and holding in isolated detention, Senior Judge of the Criminal Court, Abdulla Mohamed. Chief Justice Ahmed Faiz, Prosecutor General Ahmed Muizzu, Attorney General Abdulla Muizzu, Maldives Lawyers Association, Human Rights Commission of Maldives, and top lawyers around the country called the act a violation of the constitution and laws.
According to legal experts, Judge Abdulla's arrest on January 16th 2012, constitute gross violations of several Sections of the Constitution by President Nasheed, Home Minister Afeef, Defence Minister Tholhath, Police Commissioner Faseeh and Chief of Defence Forces Moosa Jaleel.
