Works of the courts are not in line with the changes in the Criminal Justice system: Judges
A group of judges from the Criminal Court has stated that the biggest drawback to the country after the implementation of the new constitution and the changes brought to the criminal justice system is that the courts of law are not working in line with the changes and have not properly adapted to these changes, a report by the state media MNBC One said yesterday.
According to the state media, the judges made this remark in an official letter sent to the Chief Justice Ahmed Faiz on 31st January 2012.
The judges said that the Chief Justice and Supreme Court bench have to take full responsibility of the current judiciary crisis. They said that it is a legal obligation over the Chief Justice and the Supreme Court bench to take the responsibility since the Supreme Court is the highest authority within the judicial sector.
In the letter, the judges raised several issues which they allege are the reasons for the current judicial crisis. They said that these include dissolving the authority of the Judicial Council by a verdict of the Supreme Court without any prior discussion; taking the authority of the council by the Supreme Court bench; rejecting the public interest litigation raised against the appointment of High Court bench on the claims that the plaintiff was out of reach; the Chief Justice giving a deaf ear to the many ethical issues raised against the Chief Judge of the Criminal Court; and the Chief Judge doing nothing to solve these issues, reports MNBC One.
According to the state media, the judges also noted that the Chief Justice have not tried to find a solution to the judicial crisis by holding talks with the President.
Furthermore, the letter also stated that there are many discrepancies in the system which in turn is leading the judges to release hard core criminals to the society causing much harm to the social fabric as a consequence.
The criminal court judges also noted that among the issues of the courts of law include the procrastination of certain cases resulting in the rights of many individuals being violated.
